Be it noted that this domain OpenWaterSwim.com and related domains DO NOT willingly accept spam.

Any unsolicited email which "a reasonable person" would recognize as fitting the generally-accepted definitions* of spam will attract a fee payable to the owner of this domain in the amount of $500 US per each unsolicited email received. The person(s)/corporation(s) liable will be any and all of the following:

The person(s) and/or corporation(s) directly responsible for sending the unsolicited email;
The person(s) and/or corporation(s) who authorized and/or delegated the task of sending the unsolicited email;
The person(s) and/or corporation(s) who stand to benefit or are attempting to gain benefit from the spamming

The sending of any email to the OpenWaterSwim.com or any related domain constitutes acceptance of this notice and agreement that such sending constitutes the formation of a legally binding contractual arrangement.

This notification applies to all such unsolicited emails received after 18:00 CST, January 25, 2003.

Furthermore:

In addition to the above contract, we reserve all rights and remedies granted under the Statutes and Common Law of any and all applicable jurisdictions;

We shall utilize all legal technological means available to us to trace the immediate and upstream service providers (as widely defined) of spammers, and submit abuse reports documenting the offenses committed, requesting the termination of all accounts and services associated with the spammer; and

As applicable, we shall lodge nominations for blacklisting of offending spammers (and uncooperative service providers) with the various filtering services available to the internet community.
